Terms of Service
These terms govern the photography, 3D tour, drone, floor plan and related services I provide through Virtual Tours Las Vegas, operated by Mike Madsen ("Mike", "the photographer"). When I say "I", "me" or "my" in this policy, I mean Virtual Tours Las Vegas. Booking a shoot confirms you accept these terms. Questions? Contact VirtualToursLasVegas@gmail.com or (702) 527-2732.
Service area
I provide real estate photography and related media services across the Las Vegas Valley and surrounding areas, including Las Vegas, Henderson, Summerlin, North Las Vegas, Boulder City, and all of Clark County, Nevada. Properties in nearby areas — including Mesquite NV, Pahrump NV, Moapa Valley, Overton, Logandale, Searchlight; St. George, Utah; and Kingman and Bullhead City, Arizona — are served by arrangement. Travel within the Las Vegas Valley is included at no charge; outlying and rural properties are quoted on a case-by-case basis.
Booking & scheduling
Shoots are confirmed directly with me by phone, text, or the booking/contact forms. A request submitted through the website is a request, not a confirmed reservation — the appointment is confirmed once I acknowledge it. I reserve the right to decline or reschedule a booking for any reason, including unsafe conditions, weather, or airspace restrictions.
Cancellation policy
To avoid a $35 trip fee, cancel or reschedule at least 24 hours before your scheduled appointment time. Cancellations made less than 24 hours in advance, or no-shows, are subject to the $35 trip fee. The same fee applies if the photographer arrives on site and the property is not ready to be photographed (see Property preparation), in which case the shoot will be rescheduled.
Property preparation
The property must be clean, staged and photo-ready at the scheduled time — treat it like a 24/7 open house. The photographer does not move furniture, declutter, clean, or remove personal items. Please provide access details (lockbox code, occupant contact) at booking. A property that is not ready when the photographer arrives incurs the $35 trip fee and must be rescheduled. For 3D scans that take 1–3 hours, all people and pets should vacate the property during the appointment.
Payment terms
Payment is due on delivery of the finished media (photos, tour links, floor plans, etc.). Invoices are issued by me and payable by the methods listed on the invoice (typically card, PayPal, or ACH). Unless otherwise agreed in writing, deliverables are released once the invoice is settled. Quotes are valid for 30 days.
Delivery timeline
- Still (HDR) photography: 24–48 hours, delivered via cloud storage in MLS-ready format.
- 3D virtual tours (Matterport / Zillow 3D Home): 24–48 hours with email links and an embeddable iframe.
- Floor plans: 48 hours, delivered as PDF (PNG/SVG/CAD where purchased).
- Zillow walk-through videos: 12–24 hours.
- Rush delivery (next morning): available for an additional $40, schedule permitting.
Timelines are business targets, not guarantees, and may be affected by property size, scope, weather (for exterior and drone work), and the volume of post-production required.
Pricing & quotes
Pricing is published at /pricing/ and reflects current rates. Quoted pricing is valid for 30 days. Square-footage-based pricing (e.g. Matterport, floor plans) is assessed on the photographed property's size; if the actual size differs from what was booked, the price is adjusted accordingly and communicated before delivery.
Refund policy
Because photography is a custom service performed on location, refunds are handled as follows:
- If I cancel a confirmed shoot, any deposit or prepayment is refunded in full.
- If the photos don't meet my standard due to my error, I'll re-shoot the affected work at no cost to you.
- If I can't deliver the work at all, you receive a full refund.
- Subjective preferences (editing style, composition taste) are addressed with revisions where offered, but are not grounds for a full refund once the shoot has been performed.
- The $35 trip fee, once incurred, is non-refundable.
- Rush fees are non-refundable once the rush work has begun.
Refund or re-shoot requests must be made within 7 days of delivery. Contact VirtualToursLasVegas@gmail.com with the shoot date and the issue.
Copyright & usage rights
I retain copyright in all photographs, 3D models, floor plans, videos and derivative works. Upon payment, the client receives a license to use the delivered media for real estate marketing of the photographed property — including MLS, Zillow, Realtor.com, brokerage and agent sites, print flyers, and social media — until the property sells.
- Residential resale: license ends when the property sells.
- Extended / commercial licensing is available for long-term advertising, brand campaigns, hospitality, and resale of the imagery. Contact me to arrange.
- Media may be used by the client and their authorized agents; it may not be resold, sublicensed, or transferred to unaffiliated third parties.
- I may display the work in my portfolio and marketing unless the client requests otherwise in writing at booking.
FAA drone compliance
All aerial / drone photography and video is performed by an FAA Part 107 certified remote pilot (Mike Madsen), operating under the U.S. Federal Aviation Administration's Part 107 small Unmanned Aircraft Systems rule. Flights comply with all applicable FAA regulations, including airspace authorizations near Harry Reid International Airport and other controlled airspace in the Las Vegas Valley. Drone work is weather-dependent and subject to airspace approval; flights that cannot be conducted legally or safely will be rescheduled.
Nevada sales tax
Photography services performed in Nevada are not subject to Nevada sales or use tax. Nevada's sales/use tax (NRS Chapter 372) applies to the sale of tangible personal property and specifically enumerated services; professional personal services such as photography are not among the enumerated taxable services. See NRS 372.050 and the Nevada Department of Taxation's guidance. Digital file delivery does not convert the service into a taxable sale of tangible personal property.
Matterport & third-party hosting
Matterport 3D tours include 6 months of free hosting. Continued hosting after six months is available for $72 per additional 6 months (1–99 scan points) and may be cancelled at any time. Zillow 3D Home tours are hosted by Zillow at no charge under Zillow's terms. Google Business View 360 tours are published to and hosted by Google. Each third party's terms govern the corresponding hosted content.
Limitation of liability
I am not liable for indirect, incidental or consequential damages arising from the use of delivered media. Total liability for any claim is limited to the amount paid for the specific shoot giving rise to the claim. I am not responsible for access issues, on-site hazards, or circumstances beyond my control.
Changes to these terms
I may update these terms from time to time; the "Last updated" date above reflects the most recent revision. Bookings are subject to the terms in effect at the time of the shoot.
